When you visit or interact with our services, we may collect certain information to keep you up-to-date on our programs and fundraisers. This may include name, email address, or other contact details you provide.

3. How We Use Your Information

Email Communications
With your permission, we may send you emails about our programming and fundraising events. Email addresses will never be shared with third parties or affiliates under any circumstances. The email lists you are subscribed to can be managed by clicking UPDATE YOUR PROFILE at the bottom of any email. If you no longer wish to receive emails from Kinetic Kids click UNSUBSCRIBE at the bottom of any email.

Text Communications
With your permission, we may send text messages about programming and fundraising events. SMS consent and phone numbers will never be shared with third parties or affiliates under any circumstances. If you no longer wish to receive text messages from Kinetic Kids, reply STOP to any mobile message.

4. Cookies and Tracking Technologies
Our website may use cookies and similar tracking technologies to understand your preferences and enhance your user experience. You can manage your cookie settings in your browser at any time, but keep in mind that disabling cookies might affect how our site functions for you.

5. Keeping Your Data Safe
We take security seriously. We use industry-standard security measures to protect your information. While no online service can guarantee absolute security, we work hard to safeguard your data against unauthorized access, alteration, or disclosure.

Currently, there are no diagnosis restrictions or mobility limitations that eliminate a child from participation in our programs. There are certain classes that are more appropriate for some children based on level of mobility, diagnosis, and cognitive age-level. Our goal is to provide each child the best opportunity for success within the separate divisions set forth within programs. If there is a question on which division will maximize successful participation, the program director will determine the most appropriate division for that season. Although there are no diagnosis restrictions or mobility limitations that eliminate a child from participation in programs, there are requirements for participation:

• Participant must have the personal desire to perform the activities within each program
• Participant will not prevent the instructor from teaching
• Participant will not prevent other participants from learning or participating
• Participant must demonstrate a willingness to cooperate and function in a group setting and be able to follow directions
• Participant must pose no threat or danger to themselves or others before, during, or after participation in our activities
• Participant must be medically stable to participate in the desired activity and have clearance from their medical doctor for such participation (medical release submitted annually).
• Kinetic Kids reserves the right to remove any child from the program who does not meet the basic criteria. Appropriate placement into an alternate class will be attempted, but we must keep the safety of the group as a guiding priority. If one of the instructors must give an inordinate amount of time to a child who is not suitable for the program, that situation compromises the safety as well as the enjoyment of the group as a whole.

• Kinetic Kids recreational sports divisions (Parent & Me, Champion, and Allstars) serve children 18 months to 21 years.
• Kinetic Kids’ competitive sports divisions (SA Premier and SA Xtreme) serve children 6-28 years.

Kinetic Kids provides opportunities for children with special needs through sport and recreational activities. Although we pride ourselves on empowerment through inclusion, the physical safety of every child remains paramount. Kinetic Kids reserves the discretion to limit the participation of any child when the foreseeable risk is likely to result in bodily injury.  Here are some guidelines and restrictions for participation in some of our programs:

• Any child that has had a surgical procedure or hospitalizations within the year in which a medical release has been signed requires a new medical release be completed in order to return to Kinetic Kids programs.
• Our programs are designed for group participation and children that have weakened immune systems may be compromised, therefore precautions should be taken, as deemed by the parent.
• Kinetic Kids programs require active participation from each child. While Kinetic Kids utilizes professional experienced staff who are able to adapt and modify activities based on each child’s needs and provide one-on-one volunteers to assist children with activities, we, as an organization, do not provide therapy services nor one-on-one assistance to children in the program.  Children requiring one-on-one assistance from a therapist, in order to successfully participate in the group setting may not be ready for group involvement in the Kinetic Kids programs and we recommend continuation in a therapeutic environment until they are ready for group activity.
• Kinetic Kids’ staff do not have background education and are not trained in accommodating emotional disorders. Therefore, children with severe emotional or behavioral issues are not appropriate for Kinetic Kids programs.
• Parents must notify their program director of the child’s seizure history. If a child has a seizure within 24 hours of class, they will not be allowed to participate in class that day.
• Parents of children with a history of seizures must stay within eyesight of their child at all times during the program.
• Any child that has uncontrolled seizure activity may not be appropriate for some or all of our programs. Specifically, if a child has a history of seizures that compromise their ability to keep their head above water or that interfere with their safety and active participation in the water, they are not appropriate for water sports.

• If a participant is unable to attend a class, please make all attempts to contact the program director and/or program administrator to let them know.
• If a participant does not attend the first class of a session and has not called or emailed an explanation, the spot will be released to the next person on the waiting list.
• If a participant is unable to attend a class due to illness, conflicting appointments or other family engagements, there will be no make-up for these absences. Additionally, you will not be able to attend another date or time of the same sport or program. Due to program structure, volunteer availability and facility requirements, makeup classes based on an individual basis are prohibited.
• We encourage all families to make a commitment to attend the scheduled class times. If a participant is on scholarship and there is inconsistent attendance in the programs within a season, Kinetic Kids reserves the right to review enrollment and scholarship status for future programs.

• Class schedules will be sent out prior to the first class with emailed welcome letters, unless no email is listed, and in that case, participants will be telephoned OR mailed the information.
• Kinetic Kids will cancel programs if the weather is not suitable or safe for outdoor participation. Common examples of cancellations include: Excessive rain, lightning at the time of practice, or extreme heat (over 102 degrees). If a class is cancelled due to weather, all attempts will be made to logically make up the class within a reasonable amount of time. This is often dependent on facility availability, staffing, and other program conflicts. There is no guarantee a class will be made up.
• If a class is cancelled by Kinetic Kids or if the class falls on a holiday, all attempts will be made to make up the class within a reasonable amount of time. This is often dependent on facility availability, staffing, and other program conflicts, therefore there is no guarantee a class will be made up. All attempts will be made and on occasion, we may combine classes with a similar program at one of our other facilities.
• If a class is canceled without a makeup time rescheduled, there will not be a refund for that class. Please know that Kinetic Kids discounts each program to a minimum (fees are only 25% of the true cost of programming) so all children are able to participate. There will be no more than one class canceled without a makeup scheduled within a season.

• For a family new to Kinetic Kids’ programs, there is an option to register for a program, pay for the program, but if after the first class, you do not feel it will be beneficial for your child to participate, a refund minus $10 processing fee will be given.
• Kinetic Kids will not refund entry fees after the first class is complete. Programs are designed and customized for a specific number of children. Kinetic Kids staffs according to the number of children registered. If you decide after the first class to stay enrolled in the class and later you withdraw your child, your payment will not be refunded.

• If your child is placed on a waiting list, the parent will be notified through the online registration system. If the child’s status is upgraded from the waiting list, they will be notified via email and a phone call from the program director. The parent is then responsible to sign into the online registration system, process payment and complete the registration process.
• If a child is on the waiting list and a spot does not open up, no payment is collected. When that season is over, all waiting list and registrations are cleared; waiting lists do not carryover from season to season.

Kinetic Kids is not liable and cannot control all photos taken since our programs are in a public, group setting. It is ultimately the parent/caregiver’s responsibility to ensure their child is not in photos if that is their intention.  Any photos taken at Kinetic Kids, Inc. events become the property of Kinetic Kids, Inc. and parents/guardians agree by their child’s participation:

• to hold Kinetic Kids, Inc. free and harmless from any and all liability arising out of any interview or photograph and subsequent publication or broadcasting
• to allow Kinetic Kids, Inc as well as other agencies to use photos, videos and/or interviews of the child or the child’s family as appropriate, which may include social network sites like Twitter, Facebook and YouTube, as well as Kinetic Kids’ website, publications, brochures and/or press releases.
